copyrights on well known photography depicted in interior renderings ...

I have a curious question here:

Lets say i do an interior rendering which contains some small picture frames on a sideboard. I talk about really small here, the size of A5 in a complete 360 pano interior rendering. Let's assume those depict marylin monroe and albert einstein ( both pretty well known photographs ). Is this problematic ? If yes - what if a take a picture of my flat where i have those two posters on the wall and put it on my website ? This would be problematic too then?

 

I'm not looking for a exact legal advice, just for opinion from people more familiar with the matter. I'll look to find a replacement for those two motives anyways ...

Thanks for the reply, Jeff. As i mentioned i already have replaced those iconic photographs. Curiously the advertising agency i did the renderings for was okay with using those images ( and the surely should know about the whole copyright thingy). But of course ultimately it would fall back into my responsibility as soon as problems would arise
