  1. The profession of architecture evolved out of the master craftsman of the european guild tradition, i.e., the trades of construction, and seems to be returning to that universe. The computer is only a small, but not an insignificant, part of the change and the momentous steps in the change can be tied to the 1970s, before the pc. Today, the obstacle course an idea must traverse, from conception to fruition, is far more crowded and with few or no means to escape. We are challenged to accept the camel; the public is told it is wonderful and it applauds. Architects and the profession have played a huge role in this evolution - "benign negligence". 2 cents, IMHO.

If there is just one term or condition, directly *and* indirectly related to the goods and/or services you are offering, that has the slightest chance to potentially lead to a misunderstanding is cause to have an agreement. Make it as reasonably (legally) brief as possible. A one page letter of intent (LOI) encompassing the fundamental T&C with signatures and dates from the involved parties is better than nothing. (I know!) An agreement can also help to protect against "out of the blue" attacks, a.k.a., third party suits. (Again, I know!!) Every change to an agreement or LOI should be made in writing. Follow up changes authorized during phone calls or idle chit-chat with exchanges between of written understandings. Never make a change without written authorization. Leave altruism and magnanimity at home. (I did not and then did not get paid.) If written appropriately, the contract protects all parties involved. Some clients react to agreements with mistrust and others believe they demonstrate a level of business maturity. Bottom line: trust and faith is thin ice.
  5. Absolutely. Clients also write agreements that pay small consultants or vendors immediately and let larger firms wait. Companies and firms cannot afford and are not paid to be a bank or philanthropy. If the work is for an architect, with this being one of several active projects, and not a small budget project there could be three to eight consulting firms involved accounting for upwards to 35%-50% of the project's design team total fee. Most architects do not enjoy healthy profit margins, lots of cash and do not want to burn their fee in bank charges to borrow to pay all the consultants on all the projects in the office. It is an arrangement that may be distasteful but works and, your opinion aside, it has been in practice in this country for a very long time. Keep in mind, I did not say I approve of or am defending this practice. BTW, avoid clients that do government work.
  6. So far, there has not been enough evidence to justify the "crook" word – in any context. I agree in spirit with TommyL, however, it is acceptable business practice, in this country, to not pay consultants until the client has paid the prime. Terms and conditions, including compensation, should be in the agreement.

  9. I hope it can be modernized at some point so that one "No" click makes it disappear until the next visit to cgarchitect or there is a choice to opt out of it popping up at all. Thanks for the quick explanation.
  10. Is it actually on my iphone or is it inside of cgarchitect? Only the cgarchitect forum on my iphone has this spam and every click activates it. How do I get rid of it? I have googled and nothing. I did not ask for this spam and want it gone. Hear me Quoord Systems Limited's "team of enthusiastic engineers"? My only choice is not to stop in here on my iPhone.
  11. This is a horrible subject for a cg thread. As you have presented the upcoming draconian tax increases, the equally draconian causes for the tax increases should be noted, too. Such as, the nearly $1 Tr. Iraq war, tax breaks for the top 2% and large businesses, the wild spending from 2000 thru 2007, and the collapsed economy due to small government (deregulated banking, mortgage and investment industries). We all hate taxes but realistically, how else can we get back into the black? Furthermore, you think the upcoming tax changes are bad? Wait, in one year the overdue bills will be the same or greater except individuals and small businesses will be expected to pay a greater share because the top 2% and large businesses will be loopholed out of their share. Ugh!

  14. The following is not intended to be a buzz killer but thoughts from my experiences: 1. Go to a top five law school (and graduate near the top of your class) or make sure you are wealthy. Many 2nd tier and below law school graduates are not on easy street and, if they practice law at all it is divorce and accident claim law (a.k.a., ambulance chasing). A guy I worked with had a arch degree from Harvard, returned for a law degree and found easy street with a Manhattan bank. 2. LOVE the law you practice, be motivated to set the world of law on fire and keep your nose and dagger sharp. A lawyer friend said the reason lawyers make big bucks is because that is the only way to keep them in practice. 3. Accept you are leaving the world of creating and construction for a life where you might be expected to destroy dreams, financial security and more. I do hope it will be better than your experiences with the "older men". Why have you not tried going with a bunch of people your age? Anyway, good luck. Leonard
