Jeff Mottle Posted June 12, 2009 Share Posted June 12, 2009 I was posting the news of a new Dosch car collection this evening and noticed an interesting disclaimer on the product: Since Dosch Design does not (cannot) know how the buyer will use/change the 3D models/objects of trademarked products, we advise the buyer/user of D3D: Cars 2008 models/objects to contact the car manufacturer (DaimlerChrysler, VW etc.) prior (!) to the publication of the new 3D-designs, and verify that the -intended- final design product is in compliance with the legal use of the protected image/trademark. Or if the model was used in an image that the manufacturer didn't want their brand being associated with. Sounds like overly cautious buck-passing to me. I'm willing to bet that it's related to Toyota's DMCA against auto "wallpapers" last November. I think the first line is very telling also... "Since Dosch Design does not (cannot) know how the buyer will use/change the 3D models/objects of trademarked products, we ad....." They are recognizing they can not control what happens with their product after it leaves there hand. Meaning, if you animate a car they built running over a little kid, then smashing into a pregnant women, then the beef the car manufacturer has is with you, not them. That's essentially what I was getting at though, they're passing responsibilty over to the end user to ensure the use of the product is agreeable to the car manufacturer.
