HamburgerTrain
Hi, I'm sure this has probably been discussed before but using the search on this site I cannot come up with any results. Anyway, I'm just wondering if there are any issues in legality when placing a published photograph into a render (most notably as a prop on a wall, much like a painting). I'm pretty sure it would be breaching some sort of copyright issues however I'm not an expert on the matter and would like some clarification if anyone knows about this? Especially when the client is asking to put in a preselected (somewhat well-known) photograph - can we do this?
Stan Zaslavsky
if you can get the client to sign off on a letter saying that he has copyright to the image - then if anything happens - you've always got this paper to back you up. if in doubt further - best talk to legal people about it. You cant simply pass the problem onto your client...if your aware of issues its your responsibility to deal with...it will only come back and bite you in the ar$e
Devin Johnston
Wouldn't it only be a problem if you were trying to take credit for the image or using it as a direct reason to buy a product? Let's say I did a rendering of a space that has a Coke can in it. It's a copy written object but I'm not using that product to sell my space any more than I'm using the Barcelona chair sitting next to it.
AubreyM
When Disney can get an injunction to have a daycare center remove images of mickey mouse from the walls I would tread carefully. Some companies and people are very protective of their images. Stick with Stan's advice and talk to the legal people if you are unsure.
AJLynn
In Australia? You're going to need to ask an Australian lawyer.
